Despite the Opposing Side’s Effort to Dismiss the Injuries as Degenerative, Client Gained Favorable Results 12/20/2018

Our 55-year-old client was stopped in traffic. A car to her rear struck the car immediately behind her causing it to strike the rear of our client’s vehicle. She was diagnosed with two cervical and two lumbar herniations and some radiculopathy of nerve conduction studies. However, she had no surgery or injections for pain. The insurance company for the defendant claimed a small residual impact and possible pre-existing or degenerative conditions rather than injuries from the impact. We were able to settle for the full policy for the vehicle at fault. We then proceeded to file an underinsurance claim against her own insurance company and obtain an additional amount.
