This new company client retained Song Law Firm to hire an employee in a newly created supervisory position within its department. In order to sponsor a foreign employee for E-2 employee visa, the regulation requires such a position be primarily supervisory in nature. A job title itself does not establish the position’s supervisory character. Rather, the employer must demonstrate through various documentary evidence that the position provides the employee ultimate control and responsibility for the company’s overall operations or a major component thereof. One of such evidence is the number of subordinate employees in organizational hierarchy and their respective positions and tasks to sufficiently support the supervisory employee. Given that the offered position is a newly created one for the company’s new initiative, organizational structuring was still in progress.
