negligence<\/strong><strong>\uff09<\/strong>\u539f\u5219\u3002\u5373\u4f7f\u60a8\u5bf9\u4e8b\u6545\u8d1f\u6709\u90e8\u5206\u8d23\u4efb\uff0c\u4ecd\u53ef\u83b7\u5f97\u8d54\u507f\uff0c\u4f46\u8d54\u507f\u989d\u5c06\u6309\u60a8\u7684\u8fc7\u5931\u6bd4\u4f8b\u76f8\u5e94\u51cf\u5c11\u3002\u4f46\u662f\uff0c\u5982\u679c\u60a8\u7684\u4e8b\u6545\u8d23\u4efb\u8d85\u8fc750%\uff0c\u5219\u65e0\u6cd5\u83b7\u5f97\u4efb\u4f55\u8d54\u507f\u3002<\/p>\n<p>\u65b0\u6cfd\u897f\u662f\u65e0\u8fc7\u5931\u4fdd\u9669\uff08No-Fault\uff09\u5dde\u3002\u884c\u4eba\u4e8b\u6545\u53d1\u751f\u540e\uff0c\u60a8\u81ea\u5df1\u6216\u5bb6\u5ead\u6210\u5458\u7684\u6c7d\u8f66\u5f3a\u5236\u4fdd\u9669\u4e2d\u7684\u4e2a\u4eba\u4f24\u5bb3\u4fdd\u62a4\uff08PIP\uff09\u798f\u5229\u901a\u5e38\u53ef\u4ee5\u652f\u4ed8\u521d\u59cb\u533b\u7597\u8d39\u7528\u3002<\/p>\n<p>\u65b0\u6cfd\u897f\u4eba\u8eab\u4f24\u5bb3\u8bc9\u8bbc\u7684<strong>\u8bc9\u8bbc\u65f6\u6548\u4e3a\u4e8b\u6545\u53d1\u751f\u4e4b\u65e5\u8d77<\/strong><strong>2<\/strong><strong>\u5e74<\/strong>\uff08N.J.S.A. 2A:14-2\uff09\u3002\u5982\u6d89\u53ca\u653f\u5e9c\u8f66\u8f86\uff0c\u5fc5\u987b\u5728\u65b0\u6cfd\u897f\u4fb5\u6743\u7d22\u8d54\u6cd5\uff08N.J.S.A. 59:8-8\uff09\u89c4\u5b9a\u768490\u5929\u5185\u63d0\u4ea4\u7d22\u8d54\u901a\u77e5\u3002\u9519\u8fc7\u8fd9\u4e9b\u622a\u6b62\u65e5\u671f\u53ef\u80fd\u6c38\u4e45\u5931\u53bb\u7d22\u8d54\u6743\u5229\u3002<\/p>\n<h2>\u7ebd\u7ea6\u5dde\u884c\u4eba\u7684\u6cd5\u5f8b\u6743\u5229<\/h2>\n<p>\u7ebd\u7ea6\u5dde\u4e5f\u4e3a\u53d7\u4f24\u884c\u4eba\u63d0\u4f9b\u5f3a\u6709\u529b\u7684\u4fdd\u62a4\uff0c\u4f46\u6cd5\u5f8b\u6846\u67b6\u4e0e\u65b0\u6cfd\u897f\u6709\u51e0\u4e2a\u91cd\u8981\u533a\u522b\u3002<\/p>\n<p>\u7ebd\u7ea6\u9075\u5faaCPLR \u00a7 1411\u89c4\u5b9a\u7684<strong>\u7eaf\u7cb9\u6bd4\u8f83\u8fc7\u5931\uff08<\/strong><strong>pure comparative negligence<\/strong><strong>\uff09<\/strong>\u539f\u5219\u3002\u4e0e\u65b0\u6cfd\u897f\u4e0d\u540c\uff0c\u65e0\u8bba\u60a8\u7684\u8fc7\u5931\u6bd4\u4f8b\u591a\u9ad8\uff0c\u90fd\u53ef\u4ee5\u83b7\u5f97\u8d54\u507f\u3002\u5373\u4f7f\u60a8\u88ab\u8ba4\u5b9a\u6709 80%\u621690%\u7684\u8fc7\u5931\uff0c\u4ecd\u53ef\u83b7\u5f97\u76f8\u5e94\u6bd4\u4f8b\u7684\u8d54\u507f\u3002<\/p>\n<p>\u7ebd\u7ea6\u4e5f\u662f\u65e0\u8fc7\u5931\u4fdd\u9669\u5dde\u3002\u884c\u4eba\u88ab\u89c6\u4e3a\u7ebd\u7ea6\u4fdd\u9669\u6cd5\u4e0b\u7684\u201c\u53d7\u4fdd\u4eba\u5458\u201d\uff0c\u53ef\u4ece\u8087\u4e8b\u8f66\u8f86\u7684\u4fdd\u9669\u516c\u53f8\u83b7\u5f97\u6700\u9ad8$50,000\u7684\u65e0\u8fc7\u5931\uff08PIP\uff09\u798f\u5229\u3002<\/p>\n<p>\u8981\u5728\u7ebd\u7ea6\u83b7\u5f97\u75bc\u75db\u548c\u75db\u82e6\u8d54\u507f\uff0c\u5fc5\u987b\u8bc1\u660e\u60a8\u7b26\u5408\u4fdd\u9669\u6cd5\u00a7
