Dram Shop\u6cd5\u6848<\/h2>\n<p class=\"wp-block-paragraph\"><strong>N.J.S.A. 2A:22A-5<\/strong>\uff08\u65b0\u6cfd\u897f\u8bb8\u53ef\u7ecf\u8425\u8005\u8d23\u4efb\u6cd5\uff09\u5bf9\u6301\u724c\u9152\u7c7b\u4f9b\u5e94\u8005\uff08\u9152\u5427\u3001\u9910\u5385\u3001\u9152\u7c7b\u5546\u5e97\uff09\u8ffd\u7a76\u8d23\u4efb\uff0c\u82e5\u5176\u5411\u5df2\u663e\u9189\u6001\u8005\u4f9b\u9152\u5bfc\u81f4\u5176\u540e\u9020\u6210\u4f24\u5bb3\u3002<\/p>\n<p class=\"wp-block-paragraph\"><strong>NY General Obligations Law \u00a711-101<\/strong>\uff08\u7ebd\u7ea6Dram Shop\u6cd5\u6848\uff09\u540c\u6837\u8ffd\u7a76\u7ebd\u7ea6\u4f9b\u5e94\u8005\u5411\u9189\u6001\u8005\u6216\u672a\u6210\u5e74\u4eba\u4f9b\u9152\u7684\u8d23\u4efb\u3002<\/p>\n<h2 class=\"wp-block-heading\" style=\"color:#98344A;border-bottom:2px solid #98344A;padding-bottom:6px;margin-top:32px;\">3. \u793e\u4ea4\u4e3b\u529e\u4eba\u8d23\u4efb<\/h2>\n<p class=\"wp-block-paragraph\"><strong>Kelly v. Gwinnell, 96 N.J. 538 (1984)<\/strong> \u2014\u2014\u65b0\u6cfd\u897f\u91cc\u7a0b\u7891\u5224\u51b3\uff0c\u8ba4\u5b9a\u793e\u4ea4\u4e3b\u529e\u4eba\u5bf9\u5411\u5df2\u663e\u9189\u6001\u5ba2\u4eba\u4f9b\u9152\u5bfc\u81f4\u5176\u9a7e\u9a76\u7684\u8d23\u4efb\u3002\u7ebd\u7ea6\u65e0\u7c7b\u4f3c\u666e\u901a\u6cd5\u793e\u4ea4\u4e3b\u529e\u4eba\u8d23\u4efb\uff08Coulthurst v. Kelly\uff09\u3002<\/p>\n<h2 class=\"wp-block-heading\" style=\"color:#98344A;border-bottom:2px solid #98344A;padding-bottom:6px;margin-top:32px;\">4. \u9189\u9a7e\u6848\u4ef6\u8bc1\u636e\u4fdd\u5168<\/h2>\n<ul class=\"wp-block-list\"><li>\u8b66\u65b9\u62a5\u544a\u542bBAC\uff08\u547c\u6c14\/\u8840\u6db2\u9152\u7cbe\u6d53\u5ea6\u7ed3\u679c\uff09<\/li><li>\u9152\u5427\/\u9910\u5385\u63d0\u4f9b\u996e\u54c1\u7684\u6536\u636e<\/li><li>\u8bc1\u4eba\u5bf9\u9a7e\u9a76\u5458\u660e\u663e\u9189\u6001\u7684\u9648\u8ff0<\/li><li>\u9152\u5427\u6216\u9910\u5385\u76d1\u63a7\u89c6\u9891<\/li><li>\u5211\u4e8b\u6cd5\u5ead\u8bb0\u5f55\uff08\u9189\u9a7e\u5b9a\u7f6a\u5f3a\u5316\u6c11\u4e8b\u7d22\u8d54\uff09<\/li><\/ul>\n<h2 class=\"wp-block-heading\" style=\"color:#98344A;border-bottom:2px solid #98344A;padding-bottom:6px;margin-top:32px;\">5. \u4fdd\u9669\u4fdd\u969c\u95ee\u9898<\/h2>\n<p class=\"wp-block-paragraph\">\u591a\u6570\u6c7d\u8f66\u4fdd\u5355\u8986\u76d6\u9189\u9a7e\u8d23\u4efb\u4f46\u6709\u4fdd\u5355\u9650\u989d\u3002\u91cd\u4f24\u60c5\u5f62\u4e0b\uff0c\u53d7\u5bb3\u8005\u5e94\u8ffd\u8ba8\u8087\u4e8b\u65b9\u4e2a\u4eba\u8d44\u4ea7\u53caDram Shop\u88ab\u544a\u7684\u5546\u4e1a\u8d23\u4efb\u9669\u3002\u5546\u4e1a\u9152\u7c7b\u4f9b\u5e94\u8005\u901a\u5e38\u6301\u6709$1M+\u8d23\u4efb\u4fdd\u969c\u3002<\/p>\n<h2 class=\"wp-block-heading\" style=\"color:#98344A;border-bottom:2px solid #98344A;padding-bottom:6px;margin-top:32px;\">\u5224\u4f8b\u6cd5<\/h2>\n<p class=\"wp-block-paragraph\"><strong>Kelly v. Robinson, 80 N.Y.2d 483 (1992)<\/strong> \u2014\u2014\u7ebd\u7ea6Dram Shop\u9002\u7528\u4e8e\u7236\u6bcd\u4f9b\u9152\u7ed9\u672a\u6210\u5e74\u4eba\u60c5\u5f62\u3002<\/p>\n<h2 class=\"wp-block-heading\" style=\"color:#98344A;border-bottom:2px solid #98344A;padding-bottom:6px;margin-top:32px;\">\u5e38\u89c1\u95ee\u9898<\/h2>\n<h3 class=\"wp-block-heading\" style=\"color:#404040;margin-top:24px;\">Q1. \u9189\u9a7e\u9a7e\u9a76\u5458\u65e0\u4fdd\u9669\u600e\u4e48\u529e\uff1f<\/h3>\n<p class=\"wp-block-paragraph\">\u4f7f\u7528\u672c\u4eba\u4fdd\u5355\u7684UM\u4fdd\u969c\u3002\u540c\u65f6\u63a2\u7d22Dram solid #98344A;padding-bottom:6px;margin-top:32px;\">\u865a\u6784\u6848\u4f8b\u6a21\u62df<\/h2>\n<p class=\"wp-block-paragraph\">Bergen County\u4e00\u5bb6\u5ead\u906d\u4e00\u540dBAC 0.21\u4eceHudson County\u9152\u5427\u79bb\u5f00\u7684\u9a7e\u9a76\u5458\u6b63\u9762\u76f8\u649e\u3002\u8be5\u9a7e\u9a76\u5458\u572890\u5206\u949f\u5185\u88ab\u4f9b\u5e949\u676f\u9152\uff0c\u5c3d\u7ba1\u5df2\u663e\u9189\u6001\u3002\u53d7\u5bb3\u8005\u906d\u53d7\u4e25\u91cd\u8111\u5916\u4f24\u9700\u7ec8\u8eab\u62a4\u7406\u3002\u9189\u9a7e\u9a7e\u9a76\u5458\u4e2a\u4eba\u6c7d\u8f66\u4fdd\u5355\u8017\u5c3d\u4e8e$300,000\u3002\u5728\u5b8b\u5f8b\u5e08\u4e8b\u52a1\u6240\u4ee3\u7406\u4e0b\uff0c\u5bf9\u9152\u5427\u63d0\u8d77\u7684Dram
