\u5c81\u97e9\u88d4\u59d4\u6258\u4eba,\u4e8e\u7f8e\u56fd\u5883\u5185\u63a8\u8fdb\u5c31\u4e1a\u79fb\u6c11\u6216\u5bb6\u5ead\u79fb\u6c11\u8fc7\u7a0b\u4e2d\u56e0\u79fb\u6c11\u6cd5\u4e0a\u7684 inadmissibility \u4e8b\u7531\u800c\u5728\u65e0 waiver \u60c5\u51b5\u4e0b\u53d6\u5f97\u7eff\u5361\u5b58\u5728\u56f0\u96be\u7684\u59d4\u6258\u4eba\u7c7b\u578b\u3002inadmissibility \u4e8b\u7531\u53ef\u4ee5\u8fc7\u5f80\u975e\u6cd5\u5c45\u7559\u7ecf\u5386 (unlawful presence bar)\u00b7\u7279\u5b9a misrepresentation\u00b7\u7279\u5b9a\u72af\u7f6a\u8bb0\u5f55\u7b49\u591a\u79cd\u5f62\u5f0f\u53d1\u751f\u3002\u672c\u6848\u4f8b\u7cfb\u5b8b\u5f8b\u5e08\u4e8b\u52a1\u6240\u5904\u7406\u7684\u62a4\u7406\u9886\u57df I-601 waiver \u6848\u4ef6\u5171\u901a\u6a21\u5f0f\u3002<\/p>\n<h2 style=\"color:#1a1a1a;font-size:22px;margin:32px 0 12px;border-left:4px solid #98344A;padding-left:12px;\">\u6848\u4ef6\u80cc\u666f<\/h2>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u59d4\u6258\u4eba\u7fa4\u4f53\u5728\u7eff\u5361\u7a0b\u5e8f\u7684\u6700\u7ec8\u9636\u6bb5 (\u9886\u4e8b\u9762\u8c08\u6216 I-485 \u5ba1\u67e5) \u56e0 inadmissibility \u4e8b\u7531\u88ab\u786e\u8ba4\u800c\u81f4\u7a0b\u5e8f\u505c\u6ede\u3002inadmissibility \u4e8b\u7531\u7684\u4ee3\u8868\u6027\u7c7b\u578b\u4e3a INA \u00a7 212(a)(9)(B) \u7684 3 \u5e74\/10 \u5e74 bar \u2014 \u5373\u5728\u7f8e\u56fd\u7d2f\u8ba1\u7279\u5b9a\u671f\u95f4\u4ee5\u4e0a unlawful presence \u8005,\u518d\u5165\u5883\u65f6\u81ea\u52a8\u89e6\u53d1\u7684\u6761\u6b3e\u3002\u4e3a\u514b\u670d\u8be5 bar,\u9700\u8981 waiver \u2014 \u5373 inadmissibility \u4e8b\u7531\u7684\u8c41\u514d\u7533\u8bf7\u3002<\/p>\n<h2 style=\"color:#1a1a1a;font-size:22px;margin:32px 0 12px;border-left:4px solid #98344A;padding-left:12px;\">\u6cd5\u5f8b\u8981\u4ef6<\/h2>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">I-601 waiver \u7684\u6cd5\u5f8b\u4f9d\u636e\u4e3a INA \u00a7 212(a)(9)(B)(v),\u7a0b\u5e8f\u89c4\u5b9a\u4e3a 8 C.F.R. \u00a7 212.7\u3002\u6279\u51c6\u8981\u4ef6\u5982\u4e0b:<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u2460 Qualifying relative \u2014 \u7f8e\u56fd\u516c\u6c11\u6216\u6c38\u4e45\u5c45\u6c11\u7684\u914d\u5076\u6216\u7236\u6bcd (\u5b50\u5973\u539f\u5219\u4e0a\u4e0d\u5c5e\u4e8e qualifying relative,\u4f9d waiver \u7c7b\u578b\u800c\u5b9a)<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u2461 Extreme hardship \u2014 \u82e5 waiver \u88ab\u62d2,qualifying relative \u5c06\u906d\u53d7\u7684 extreme hardship \u8bc1\u660e<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u2462 Discretionary approval \u2014 \u5e94\u7b26\u5408 USCIS \u88c1\u91cf\u6279\u51c6\u4e8b\u7531 (\u80af\u5b9a\u56e0\u7d20\u5e94\u8d85\u8fc7\u5426\u5b9a\u56e0\u7d20)<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">Extreme hardship \u5224\u65ad\u6807\u51c6\u4ee5 Matter of Cervantes-Gonzalez, 22 I&amp;N Dec. 560 (BIA 1999) \u7b49\u786e\u7acb\u7684 factors \u4e3a\u57fa\u7840,USCIS Policy Manual Volume 9, Part B, Chapter 5 \u4ea6\u4f5c\u8be6\u7ec6\u89c4\u5b9a\u3002<\/p>\n<h2 style=\"color:#1a1a1a;font-size:22px;margin:32px 0 12px;border-left:4px solid #98344A;padding-left:12px;\">\u5b8b\u5f8b\u5e08\u4e8b\u52a1\u6240\u5bf9\u7b56<\/h2>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u5b8b\u5f8b\u5e08\u4e8b\u52a1\u6240\u5c06 extreme hardship \u7684\u8bc1\u660e\u4f53\u7cfb\u5316\u4e3a\u4ee5\u4e0b factor \u7ec4\u3002<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u7b2c\u4e00,\u5065\u5eb7\u56e0\u7d20 \u2014 qualifying relative \u7684\u533b\u5b66\u72b6\u6001\u00b7\u6301\u7eed\u6cbb\u7597\u5fc5\u8981\u6027\u00b7\u7f8e\u56fd\u5883\u5185\u533b\u7597\u53ef\u53ca\u6027\u4e0e\u97e9\u56fd\u00b7\u6d77\u5916\u533b\u7597\u53ef\u53ca\u6027\u7684\u6bd4\u8f83\u3002\u9644\u4e0a\u533b\u751f soken \u89c1\u4e66\u00b7\u8bca\u65ad\u4e66\u00b7\u5904\u65b9\u8bb0\u5f55\u3002<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u7b2c\u4e8c,\u8d22\u52a1\u56e0\u7d20 \u2014 \u5c06 qualifying relative \u5728\u7f8e\u56fd\u5883\u5185\u7684\u8d22\u52a1\u7a33\u5b9a\u6027\u00b7\u59d4\u6258\u4eba\u5206\u5c45\u65f6\u5c06\u53d1\u751f\u7684\u6536\u5165\u51cf\u5c11\u00b7\u629a\u517b\u8d39\u8d1f\u62c5\u00b7mortgage \u7b49\u503a\u52a1\u5c65\u884c\u56f0\u96be\u00b7\u8d22\u4ea7\u635f\u5931\u53ef\u80fd\u6027\u4ee5\u6587\u4ef6\u6574\u7406\u3002<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u7b2c\u4e09,\u60c5\u611f\u00b7\u5fc3\u7406\u56e0\u7d20 \u2014 \u5c31\u5206\u5c45\u6240\u81f4\u5fc3\u7406 hardship \u53d6\u5f97\u7cbe\u795e\u79d1\u4e13\u4e1a\u533b\u5e08\u6216\u5fc3\u7406\u54a8\u8be2\u5e08\u7684 evaluation letter\u3002\u9644\u4e0a\u5e76\u975e\u5355\u7eaf\u60c5\u611f\u8bc9\u6c42\u800c\u662f\u5ba2\u89c2\u4e34\u5e8a\u8bc4\u4f30\u8005\u5177\u51b3\u5b9a\u6027\u3002<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u7b2c\u56db,\u56fd\u5bb6\u6761\u4ef6 (country conditions) \u2014 \u82e5 qualifying relative \u4e0e\u59d4\u6258\u4eba\u4e00\u540c\u79fb\u5c45\u6d77\u5916\u5c06\u906d\u9047\u7684 hardship (\u8bed\u8a00\u00b7\u6587\u5316\u00b7\u5b89\u5168\u00b7\u533b\u7597\u00b7\u6559\u80b2\u7b49) \u8d44\u6599\u3002<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u7b2c\u4e94,\u6559\u80b2\u00b7\u793e\u4f1a\u56e0\u7d20 \u2014 \u5b50\u5973\u6559\u80b2\u7684\u6301\u7eed\u6027\u00b7\u4e0e\u7f8e\u56fd\u5b66\u6821\u4f53\u7cfb\u7684\u5dee\u8ddd\u00b7\u793e\u4f1a\u5173\u7cfb\u7f51\u7684\u4e27\u5931\u7b49\u3002<\/p>\n<p \u5ba1\u67e5,\u6545\u5c06\u591a\u4e2a factor \u6574\u5408\u4e3a\u5355\u4e00 narrative \u5411\u5ba1\u67e5\u5b98\u4f20\u8fbe total hardship \u7684 brief \u6784\u6210\u4e3a\u6838\u5fc3\u3002<\/p>\n<h2 style=\"color:#1a1a1a;font-size:22px;margin:32px 0 12px;border-left:4px solid #98344A;padding-left:12px;\">\u5904\u7406\u8fc7\u7a0b\u53ca\u65f6\u95f4\u7ebf<\/h2>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u7b7e\u8ba2 retainer \u540e,\u6536\u96c6 qualifying relative \u7684\u6587\u4ef6\u00b7\u533b\u5b66\u00b7\u8d22\u52a1\u00b7\u5fc3\u7406 evaluation \u8017\u65f6\u6570\u5468\u81f3\u6570\u6708\u3002Extreme hardship brief \u521d\u7a3f\u64b0\u5199\u540e\u7ecf\u4e0e\u59d4\u6258\u4eba\u00b7qualifying relative \u7684\u5ba1\u9605\u4f1a\u8bae,\u5411 USCIS \u63d0\u4ea4\u6700\u7ec8\u7248\u672c\u3002\u5ba1\u67e5\u671f\u95f4\u82e5\u88ab\u8981\u6c42\u8865\u5145\u8d44\u6599\u5219\u8fc5\u901f\u63d0\u4ea4 supplement\u3002<\/p>\n<figure class=\"wp-caption factor \u7684\u5217\u4e3e,\u800c\u5e94\u7efc\u5408 qualifying relative \u7684 total \u72b6\u51b5,\u6784\u5efa &quot;\u672c\u6848\u4ef6\u6784\u6210 extreme hardship&quot; \u7684 aggregate narrative\u3002\u533b\u5b66\u00b7\u8d22\u52a1\u00b7\u5fc3\u7406\u00b7\u56fd\u5bb6\u6761\u4ef6\u8d44\u6599\u7684\u5ba2\u89c2\u6027\u4e0e brief
