Silver, 387 N.J. Super. 112 (App. Div. 2006) \u786e\u7acb\u7684\u4e24\u6b65\u5206\u6790\u6cd5\u4e3b\u5bfc\u3002\u7b2c\u4e00,\u7533\u8bf7\u4eba\u987b\u4ee5\u4f18\u52bf\u8bc1\u636e(preponderance of the evidence)\u8bc1\u660e\u53d1\u751f\u4e86 N.J.S.A. 2C:25-19(a) \u6240\u5217\u660e\u7684\u5bb6\u5ead\u66b4\u529b\u5148\u51b3\u884c\u4e3a(assault\u3001harassment\u3001terroristic threats \u7b49)\u4e4b\u4e00\u3002\u7b2c\u4e8c,\u7533\u8bf7\u4eba\u987b\u8bc1\u660e\u4e3a\u4fdd\u62a4\u5176\u514d\u4e8e\u672a\u6765\u4f24\u5bb3,\u7b7e\u53d1FRO \u662f\u5fc5\u8981\u7684\u3002\u4e24\u9879\u8981\u4ef6\u987b\u540c\u65f6\u6ee1\u8db3;\u4efb\u4e00\u9879\u4e0d\u6210\u7acb,FRO \u5747\u4e0d\u5f97\u7b7e\u53d1\u3002<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u540c\u65f6,\u5211\u4e8b\u7a0b\u5e8f(Simple Assault \u6307\u63a7)\u72ec\u7acb\u8fdb\u884c,\u68c0\u5bdf\u5b98\u987b\u4ee5\u6392\u9664\u5408\u7406\u6000\u7591\u7684\u8bc1\u660e\u6807\u51c6\u8bc1\u660e\u4f24\u5bb3\u884c\u4e3a\u7684\u8981\u4ef6\u3002<\/p>\n<h2 style=\"color:#1a1a1a;font-size:22px;margin:32px 0 12px;border-left:4px solid #98344A;padding-left:12px;\">\u5b8b\u5f8b\u5e08\u4e8b\u52a1\u6240\u5bf9\u7b56<\/h2>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u902e\u6355\u6b21\u65e5\u665a\u95f4,D\u5148\u751f\u914d\u5076\u7684\u4eb2\u5c5e\u7ecf\u4ecb\u7ecd\u8054\u7cfb\u672c\u6240,\u5b8b\u5f8b\u5e08\u4e8b\u52a1\u6240\u5211\u4e8b\u8fa9\u62a4\u56e2\u961f\u7acb\u5373\u4ecb\u5165\u3002\u5224\u65ad\u6700\u521d24\u5c0f\u65f6\u5177\u51b3\u5b9a\u610f\u4e49,\u5e76\u540c\u6b65\u63a8\u8fdb\u4ee5\u4e0b\u591a\u4e2a\u8f68\u9053\u3002<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u7b2c\u4e00,\u8bc1\u636e\u4fdd\u5168\u3002\u4e8b\u4ef6\u5f53\u65e5\u592b\u59bb\u95f4\u7684\u77ed\u4fe1\u3001\u7535\u5b50\u90ae\u4ef6\u4e0e\u901a\u8bdd\u8bb0\u5f55\u7acb\u5373\u4e88\u4ee5\u4fdd\u5168\u3002\u7279\u522b\u662f\u4e89\u6267\u524d\u540e\u7684\u5bf9\u8bdd\u5185\u5bb9,\u4ee5\u53ca\u4e8b\u4ef6\u53d1\u751f\u540e\u914d\u5076\u5411D\u5148\u751f\u53d1\u9001\u7684\u9053\u6b49\u6027\u8baf\u606f,\u5747\u4ee5\u539f\u59cb\u5f62\u5f0f\u786e\u4fdd\u3002<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u7b2c\u4e8c,\u60c5\u5883\u8bc1\u4eba\u3002\u51c6\u5907\u4e86\u4e8b\u53d1\u5f53\u65f6\u4f4f\u6240\u9644\u8fd1\u90bb\u5c45\u7684\u9648\u8ff0\u3001\u4e8b\u540e\u914d\u5076\u5411\u4eb2\u53cb\u63cf\u8ff0\u60c5\u51b5\u7684\u8bc1\u8bcd\u3001\u4ee5\u53ca\u4e8b\u53d1\u5f53\u65e5D\u5148\u751f\u60c5\u7eea\u72b6\u6001\u7684\u516c\u53f8\u540c\u4e8b\u4e0e\u5bb6\u4eba\u8bc1\u8bcd\u3002<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u7b2c\u4e09,\u533b\u7597\u8bb0\u5f55\u3002\u786e\u8ba4\u914d\u5076\u672a\u524d\u5f80\u6025\u8bca\u4ea6\u65e0\u4efb\u4f55\u533b\u7597\u8bb0\u5f55,\u652f\u6301\u56e0\u8be5\u63a5\u89e6\u5e76\u672a\u9020\u6210\u8eab\u4f53\u4f24\u5bb3\u3002<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u7b2c\u56db,\u542c\u8bc1\u7b56\u7565\u3002\u9488\u5bf9 Silver v. Silver \u4e24\u6b65\u5206\u6790\u7684\u6bcf\u4e00\u6b65,\u7cfb\u7edf\u6574\u7406\u9632\u5fa1\u6750\u6599\u4ee5\u8bc1\u660e:(1)\u8f7b\u5fae\u8eab\u4f53\u63a5\u89e6\u4e0d\u6ee1\u8db3\u5bb6\u5ead\u66b4\u529b\u5148\u51b3\u884c\u4e3a\u7684\u6784\u6210\u8981\u4ef6,(2)\u4e0d\u5b58\u5728\u9700\u8981\u672a\u6765\u4fdd\u62a4\u7684\u884c\u4e3a\u6a21\u5f0f(pattern of conduct)\u3002<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u7b2c\u4e94,\u5211\u4e8b\u8f68\u9053\u5e76\u884c\u3002\u5c31 Simple Assault \u6307\u63a7,\u4e0e\u5e02\u68c0\u5bdf\u5b98\u529e\u516c\u5ba4\u65e9\u671f\u6c9f\u901a,\u57fa\u4e8e\u6848\u4ef6\u5b9e\u9645\u4e8b\u5b9e\u4e0e\u914d\u5076\u9648\u8ff0\u53d8\u5316,\u8bf7\u6c42\u91cd\u65b0\u8bc4\u4f30\u8be5\u6307\u63a7\u3002<\/p>\n<h2 style=\"color:#1a1a1a;font-size:22px;margin:32px 0 12px;border-left:4px solid #98344A;padding-left:12px;\">\u5904\u7406\u8fc7\u7a0b\u4e0e\u65f6\u95f4\u7ebf<\/h2>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u7b2c1\u5468:\u902e\u6355\u6b21\u65e5\u9762\u8c08,\u7acb\u5373\u63d0\u4ea4\u59d4\u4efb\u72b6\u3002\u542f\u52a8\u914d\u5076\u65b9\u77ed\u4fe1\u4e0e\u90ae\u4ef6\u4fdd\u5168\u3002\u5f00\u59cb\u63a5\u89e6\u8bc1\u4eba\u3002<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u7b2c2\u5468:FRO\u542c\u8bc1\u51c6\u5907\u3002\u5ba1\u67e5\u7533\u8bf7\u4eba(\u914d\u5076)\u65b9\u9648\u8ff0\u4e0e\u8bc1\u636e\u6e05\u5355\u3002\u6574\u7406\u9488\u5bf9 Silver v.
