Theft Act(P.L. 2019, c.212)\u4f7f\u8be5\u5dde\u6210\u4e3a\u5168\u7f8e\u5bf9\u5458\u5de5\u4fdd\u62a4\u6700\u5f3a\u7684\u53f8\u6cd5\u8f96\u533a\u4e4b\u4e00\u3002\u672c\u6587\u68b3\u7406\u4fee\u6cd5\u540e\u5f3a\u5316\u7684\u5236\u5ea6\u53ca\u5458\u5de5\u5b9e\u9645\u53ef\u7528\u7684\u8ffd\u8ba8\u9014\u5f84\u3002<\/p>\n<h2 style=\"color:#1a1a1a;font-size:22px;margin:32px 0 12px;border-left:4px solid #98344A;padding-left:12px;\">Wage Theft Act 2019 \u6982\u8ff0<\/h2>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">2019\u5e74\u4fee\u6b63\u6848\u5728\u539f\u6709NJ Wage Payment Law(N.J.S.A. 34:11-4.1\u53ca\u4ee5\u4e0b)\u548cNJ Wage and Hour Law(N.J.S.A. 34:11-56a\u53ca\u4ee5\u4e0b)\u57fa\u7840\u4e0a\u5927\u5e45\u589e\u5f3a\u6267\u884c\u529b\u5ea6\u3002\u6838\u5fc3\u53d8\u5316\u6709\u56db:\u65f6\u6548\u5ef6\u957f\u3001\u635f\u5bb3\u8d54\u507f\u500d\u6570\u63d0\u9ad8\u3001\u96c7\u4e3b\u4e2a\u4eba\u8fde\u5e26\u8d23\u4efb\u3001\u62a5\u590d\u7981\u6b62\u6761\u6b3e\u5f3a\u5316\u3002\u8054\u90a6FLSA(29 U.S.C. \u00a7 201\u53ca\u4ee5\u4e0b)\u4ec5\u8bbe\u7acb\u6700\u4f4e\u6807\u51c6,NJ\u5dde\u5458\u5de5\u5728\u66f4\u6709\u5229\u6761\u6b3e\u4e0b\u5e94\u4f18\u5148\u63f4\u5f15\u5dde\u6cd5\u3002<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u5f3a\u5316\u5904\u7f5a \u2014 200%\u60e9\u7f5a\u6027\u8d54\u507f<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u4fee\u6cd5\u524d,\u672a\u4ed8\u5de5\u8d44\u539f\u544a\u57fa\u672c\u53ea\u80fd\u8ffd\u56de\u672c\u91d1\u3002\u4fee\u6cd5\u540e\u53ef\u989d\u5916\u8ffd\u8ba8\u76f8\u5f53\u4e8e\u6b20\u6b3e\u672c\u91d1200%\u7684liquidated damages,\u5b9e\u9645\u76f8\u5f53\u4e8e\u672c\u91d1\u76843\u500d(\u672c\u91d1+200%)\u3002\u96c7\u4e3b\u987b\u8bc1\u660e\u5176\u5584\u610f\u5408\u89c4\u624d\u6709\u53ef\u80fd\u51cf\u514d,\u4e3e\u8bc1\u8d23\u4efb\u6781\u9ad8,\u5b9e\u8df5\u4e2d\u9c9c\u5c11\u6210\u7acb\u3002<\/p>\n<h2 style=\"color:#1a1a1a;font-size:22px;margin:32px 0 12px;border-left:4px solid #98344A;padding-left:12px;\">\u65f6\u6548\u5ef6\u957f\u81f36\u5e74<\/h2>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u7d22\u8d54\u65f6\u6548\u7531\u539f2\u5e74\u5ef6\u957f\u81f36\u5e74(N.J.S.A. 34:11-56a25.1)\u3002\u957f\u671f\u5728\u804c\u8005\u53ef\u8ffd\u6eaf6\u5e74\u5185\u7684\u6b20\u85aa \u2014\u2014 \u5bf9\u9910\u996e\u3001\u9152\u5e97\u3001\u5efa\u7b51\u4e1a\u5458\u5de5\u5c24\u4e3a\u91cd\u8981,\u8fd9\u4e9b\u884c\u4e1a\u5f80\u5f80\u79ef\u7d2f\u591a\u5e74\u5c0f\u989d\u8fdd\u89c4\u3002\u8054\u90a6FLSA\u4ecd\u4e3a2\u5e74(\u6545\u610f\u8fdd\u89c43\u5e74),NJ\u5dde\u6cd5\u901a\u5e38\u66f4\u6709\u5229\u3002<\/p>\n<h2 style=\"color:#1a1a1a;font-size:22px;margin:32px 0 12px;border-left:4px solid #98344A;padding-left:12px;\">\u96c7\u4e3b\u4e2a\u4eba\u8fde\u5e26\u8d23\u4efb<\/h2>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u6709\u9650\u8d23\u4efb\u516c\u53f8(LLC)\u3001\u80a1\u4efd\u516c\u53f8\u7684\u6240\u6709\u4eba\u3001\u9ad8\u7ba1\u3001\u6267\u884c\u6210\u5458\u4e0e\u516c\u53f8\u627f\u62c5\u8fde\u5e26\u8d23\u4efb(\u4fee\u6b63\u540eN.J.S.A. 34:11-4.1)\u3002\u516c\u53f8\u89e3\u6563\u6216\u8d44\u4ea7\u67af\u7aed\u4e0d\u518d\u80fd\u5c4f\u853d\u8ffd\u8ba8,\u53ef\u76f4\u63a5\u8ffd\u53ca\u4e2a\u4eba\u8d44\u4ea7\u3002\u60ef\u72af\u8fd8\u53ef\u80fd\u9762\u4e34\u4e09\u7ea7\u4ee5\u4e0a\u5211\u4e8b\u8d23\u4efb\u3002<\/p>\n<h2 style=\"color:#1a1a1a;font-size:22px;margin:32px 0 12px;border-left:4px solid #98344A;padding-left:12px;\">\u62a5\u590d\u7981\u6b62\u5f3a\u5316<\/h2>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u56e0\u5458\u5de5\u63d0\u51fa\u6216\u534f\u52a9\u5de5\u8d44\u6295\u8bc9\u800c\u906d\u89e3\u96c7\u3001\u51cf\u5de5\u65f6\u3001\u53d8\u66f4\u73ed\u8868\u3001\u964d\u804c\u7b49,\u9664\u672c\u8eab\u8fdd\u6cd5\u5916\u8fd8\u987b\u989d\u5916\u652f\u4ed8\u76f8\u5f53\u4e8e\u6240\u6d89\u5de5\u8d445\u500d\u7684\u62a5\u590d\u8d54\u507f\u3002\u53d7\u4fdd\u62a4\u6d3b\u52a8\u540e90\u5929\u5185\u7684\u4efb\u4f55\u4e0d\u5229\u5904\u7f6e\u5747\u63a8\u5b9a\u4e3a\u62a5\u590d,\u96c7\u4e3b\u987b\u4e3e\u8bc1\u53cd\u9a73\u3002<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u5458\u5de5\u53ef\u4e8c\u9009\u4e00:(1) \u65b0\u6cfd\u897f\u5dde\u52b3\u5de5\u90e8(NJDOL)Wage Collection Division\u884c\u653f\u6295\u8bc9,\u514d\u8d39,\u9002\u5408\u5c0f\u989d\u3001\u4e8b\u5b9e\u7b80\u5355\u6848\u4ef6\u3002(2) \u901a\u8fc7\u5f8b\u5e08\u63d0\u8d77\u6c11\u4e8b\u8bc9\u8bbc,\u9002\u5408\u91d1\u989d\u8f83\u5927\u3001\u4e8b\u5b9e\u590d\u6742\u6216\u591a\u540d\u5458\u5de5\u96c6\u4f53\u8bc9\u8bbc(collective action)\u3002\u5148\u5411NJDOL\u6295\u8bc9\u5e76\u4e0d\u653e\u5f03\u8bc9\u8bbc\u6743\u3002<\/p>\n<h2 style=\"color:#1a1a1a;font-size:22px;margin:32px 0 12px;border-left:4px solid #98344A;padding-left:12px;\">\u4e0eFLSA\u7684\u5173\u7cfb<\/h2>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u8054\u90a6FLSA\u4e0eNJ\u5dde\u6cd5\u5e76\u884c\u9002\u7528,\u53d6\u66f4\u6709\u5229\u4e8e\u5458\u5de5\u7684\u6761\u6b3e\u3002NJ\u76846\u5e74\u65f6\u6548\u4e0e200% liquidated damages\u901a\u5e38\u4f7f\u5dde\u6cd5\u7d22\u8d54\u4e3a\u4e3b,\u800cFLSA\u96c6\u4f53\u8bc9\u8bbc\u673a\u5236\u5728\u591a\u539f\u544a\u6848\u4ef6\u4e2d\u4ecd\u6709\u7528\u3002NJ\u6700\u4f4e\u5de5\u8d44\u4ea6\u9ad8\u4e8e\u8054\u90a6\u6807\u51c6,\u5e76\u9010\u5e74\u4e0a\u8c03\u3002<\/p>\n<p Stub)\u3001\u73ed\u6b21\u6c9f\u901a\u77ed\u4fe1\u3001\u94f6\u884c\u8f6c\u8d26\u8bb0\u5f55\u5907\u4efd\u81f3\u4e2a\u4eba\u4e91\u7aef\u3002\u4f9dAnderson v. Mt. Clemens Pottery\u539f\u5219,\u96c7\u4e3b\u672a\u4fdd\u5b58\u8bb0\u5f55\u65f6\u5458\u5de5\u7684\u5408\u7406\u4f30\u7b97\u5177\u8bc1\u636e\u6548\u529b,\u4f46\u62e5\u6709\u5f53\u65f6\u8bb0\u5f55\u53ef\u663e\u8457\u63d0\u5347\u8ffd\u8ba8\u91d1\u989d\u3002<\/p>\n<h2 \u53ef\u4ee5\u3002\u5de5\u8d44\u6743\u4e0e\u79fb\u6c11\u8eab\u4efd\u65e0\u5173,NJDOL\u4e0e\u5dde\u6cd5\u9662\u5904\u7406\u5de5\u8d44\u6848\u4ef6\u65f6\u4e0d\u67e5\u8be2\u8eab\u4efd\u3002\u9886\u5c0f\u8d39\u5458\u5de5\u662f\u5426\u53d7\u4fdd\u62a4? \u2014\u2014 \u662f\u3002tip credit\u4e0d\u5408\u89c4\u3001tip
