Nwobu \u7b49\u5224\u4f8b\u5411\u6cd5\u9662\u7533\u8bf7\u590d\u6838\u3002<\/p>\n<h2 style=\"color:#1a1a1a;font-size:22px;margin:32px 0 12px;border-left:4px solid #98344A;padding-left:12px;\">\u7533\u8bf7\u7a0b\u5e8f<\/h2>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u7533\u8bf7\u987b\u5728\u63d0\u5ba1(arraignment)\u540e 28 \u65e5\u5185\u4ee5\u4e66\u9762\u5f62\u5f0f\u5411 Criminal Division Manager \u63d0\u4ea4\u3002\u7533\u8bf7\u6587\u4ef6\u5305\u62ec\u4e2a\u4eba\u80cc\u666f\u3001\u4e8b\u5b9e\u9648\u8ff0\u3001\u5eb7\u590d\u8ba1\u5212\u3001\u54a8\u8be2\/\u6cbb\u7597\u767b\u8bb0\u8bc1\u660e\u7b49\u3002Criminal Division \u8c03\u67e5\u540e\u8fde\u540c\u68c0\u65b9\u610f\u89c1\u5411\u6cd5\u9662\u63d0\u4ea4\u5efa\u8bae\u4e66\u3002\u68c0\u65b9\u62d2\u7edd\u65f6\u88ab\u544a\u53ef\u5411\u5ba1\u5224\u5ead\u4e0a\u8bc9\u3002\u5b9e\u52a1\u4e0a\u521d\u671f\u63d0\u4ea4\u6750\u6599\u7684\u5b8c\u6574\u5ea6 &#8211; \u80cc\u666f\u6587\u4ef6\u3001\u652f\u6301\u4fe1\u3001\u6cbb\u7597\u767b\u8bb0\u8bb0\u5f55 &#8211; \u5bf9\u7ed3\u679c\u5f71\u54cd\u5de8\u5927\u3002<\/p>\n<h2 style=\"color:#1a1a1a;font-size:22px;margin:32px 0 12px;border-left:4px solid #98344A;padding-left:12px;\">\u76d1\u7763\u6761\u4ef6 &#8211; 12 \u81f3 36 \u4e2a\u6708<\/h2>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u83b7\u51c6\u540e\u76d1\u7763\u671f\u901a\u5e38\u4e3a 12 \u81f3 36 \u4e2a\u6708\u3002\u5e38\u89c1\u6761\u4ef6\u5305\u62ec:\u5b9a\u671f\u5411\u76d1\u7763\u5b98\u62a5\u5230\u3001\u968f\u673a\u5c3f\u68c0\u3001\u836f\u7269\/\u9152\u7cbe\u54a8\u8be2\u3001\u793e\u533a\u670d\u52a1\u65f6\u6570\u3001\u5fc5\u8981\u65f6\u7684\u8d54\u507f\u5c65\u884c\u3001\u671f\u95f4\u4e0d\u5f97\u518d\u72af\u4efb\u4f55\u5211\u4e8b\u6848\u4ef6\u3002\u8fdd\u53cd\u6761\u4ef6\u5c06\u5bfc\u81f4 PTI \u7ec8\u6b62,\u539f\u6848\u4ef6\u6062\u590d\u6b63\u5f0f\u8d77\u8bc9\u3002<\/p>\n<h2 style=\"color:#1a1a1a;font-size:22px;margin:32px 0 12px;border-left:4px solid #98344A;padding-left:12px;\">\u5b8c\u6210\u540e\u679c &#8211; \u64a4\u8bc9\u4e0e\u8bb0\u5f55\u6d88\u9664<\/h2>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u65e0\u8fdd\u53cd\u5730\u5b8c\u6210\u76d1\u7763\u671f\u540e,\u539f\u8d77\u8bc9\u5c06\u6b63\u5f0f\u64a4\u9500\u3002\u56e0\u672a\u6784\u6210\u6709\u7f6a\u5224\u51b3(conviction),\u5211\u4e8b\u8bb0\u5f55\u62a5\u544a\u4e2d\u4e0d\u663e\u793a\u6709\u7f6a\u5904\u7f6e\u3002PTI \u5b8c\u6210 6 \u4e2a\u6708\u540e\u4f9d N.J.S.A. 2C:52-6 \u53ef\u7533\u8bf7\u5bf9\u902e\u6355\u4e0e\u8d77\u8bc9\u8bb0\u5f55\u672c\u8eab\u7684\u6d88\u9664(expungement)\u3002\u6d88\u9664\u5b8c\u6210\u540e\u5927\u591a\u6570\u80cc\u666f\u8c03\u67e5\u548c\u6807\u51c6\u5c31\u4e1a\u7533\u8bf7\u65e0\u9700\u62ab\u9732\u8be5\u8bb0\u5f55\u3002<\/p>\n<h2 style=\"color:#1a1a1a;font-size:22px;margin:32px 0 12px;border-left:4px solid #98344A;padding-left:12px;\">\u5927\u9ebb\u4e0e\u5176\u4ed6\u7ba1\u5236\u7269\u8d28\u7684\u533a\u522b<\/h2>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">2021 \u5e74\u65b0\u6cfd\u897f\u5dde\u5c06 21 \u5c81\u4ee5\u4e0a\u6210\u4eba\u7684\u4f11\u95f2\u7528\u5927\u9ebb\u5408\u6cd5\u5316(N.J.S.A. 24:6I-31 \u53ca\u4ee5\u4e0b)\u300221 \u5c81\u4ee5\u4e0a\u6210\u4eba\u6301\u6709 6 \u76ce\u53f8(\u7ea6 170 \u514b)\u4ee5\u4e0b\u8005\u4e0d\u53d7\u5211\u4e8b\u8ffd\u8bc9\u3002\u7136\u800c 21 \u5c81\u4ee5\u4e0b\u8005\u3001\u5b66\u6821\u533a\u57df\u7b49\u7981\u6b62\u573a\u6240\u4f7f\u7528\u3001\u4ee5\u8d29\u5356\u4e3a\u76ee\u7684\u7684\u6301\u6709\u4ecd\u6784\u6210\u5211\u4e8b\u72af\u7f6a,PTI \u5728\u8fd9\u4e9b\u6848\u4ef6\u4e2d\u662f\u5e38\u7528\u51fa\u8def\u3002\u53ef\u5361\u56e0\u3001\u6d77\u6d1b\u56e0\u3001\u82ac\u592a\u5c3c\u3001\u5904\u65b9\u836f(CDS Schedule I~V)\u6301\u6709\u4ecd\u5b8c\u5168\u5211\u4e8b\u5316,PTI \u8d44\u683c\u53d6\u51b3\u4e8e\u6570\u91cf\u4e0e\u524d\u79d1\u3002<\/p>\n<h2 style=\"color:#1a1a1a;font-size:22px;margin:32px 0 12px;border-left:4px solid #98344A;padding-left:12px;\">\u79fb\u6c11\u8eab\u4efd\u5f71\u54cd &#8211; \u5173\u952e\u8b66\u544a<\/h2>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u6b64\u5904\u6709\u5173\u952e\u8b66\u544a\u3002PTI \u5728\u65b0\u6cfd\u897f\u5dde\u6cd5\u4e0b\u4e0d\u6784\u6210\u6709\u7f6a\u5224\u51b3,\u4f46\u8054\u90a6\u79fb\u6c11\u6cd5(INA \u00a7101(a)(48))\u7684 conviction \u5b9a\u4e49\u66f4\u4e3a\u5bbd\u6cdb\u3002\u82e5\u7a0b\u5e8f\u8981\u6c42\u8ba4\u7f6a\u7b54\u8fa9(guilty plea)\u6216\u4e8b\u5b9e\u627f\u8ba4(sufficient facts)\u540e\u63a5\u53d7\u76d1\u7763,\u79fb\u6c11\u5f53\u5c40\u53ef\u80fd\u89c6\u4e4b\u4e3a conviction\u3002\u8fd9\u53ef\u80fd\u5f15\u53d1 CIMT \u540e\u679c\u3001\u6bd2\u54c1\u76f8\u5173\u4e0d\u53ef\u5165\u5883\u4e8b\u7531,\u6216\u6c38\u4e45\u5c45\u6c11\u8eab\u4efd\u4e27\u5931\u3002F-1 \u5b66\u751f\u3001H-1B \u6301\u6709\u8005\u3001\u6c38\u4e45\u5c45\u6c11\u3001\u65e0\u8eab\u4efd\u8005\u5728\u8fdb\u5165 PTI \u524d\u5fc5\u987b\u8fdb\u884c\u5211\u4e8b\u4e0e\u79fb\u6c11\u7efc\u5408\u54a8\u8be2\u3002<\/p>\n<h2 style=\"color:#1a1a1a;font-size:22px;margin:32px 0 12px;border-left:4px solid #98344A;padding-left:12px;\">\u5e38\u89c1\u95ee\u9898<\/h2>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">\u53c2\u52a0 PTI \u672c\u8eab\u662f\u5426\u7b49\u540c\u4e8e\u8ba4\u7f6a? &#8211; \u56e0\u90e1\u4e0e\u6848\u4ef6\u800c\u5f02\u3002\u67d0\u4e9b\u6cd5\u9662\u65e0\u9700\u7b54\u8fa9\u5373\u53ef\u8fdb\u884c,\u67d0\u4e9b\u5219\u8981\u6c42\u8ba4\u7f6a\u6216\u4e8b\u5b9e\u627f\u8ba4,\u7b7e\u7f72\u4efb\u4f55\u6587\u4ef6\u524d\u52a1\u5fc5\u786e\u8ba4\u3002\u7533\u8bf7\u88ab\u62d2\u540e\u4f1a\u600e\u6837? &#8211; \u6848\u4ef6\u56de\u5230\u6807\u51c6\u5211\u4e8b\u8f68\u9053;\u53ef\u8bc4\u4f30 conditional dismissal \u6216\u534f\u5546\u7b54\u8fa9\u7b49\u66ff\u4ee3\u65b9\u6848\u3002\u662f\u5426\u53ef\u518d\u6b21\u7533\u8bf7? &#8211; \u539f\u5219\u4e0a PTI \u4e00\u751f\u4e00\u6b21,\u4f8b\u5916\u60c5\u51b5\u4e0b\u6709\u5148\u4f8b\u8ba4\u53ef\u3002<\/p>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">PTI \u53ef\u80fd\u663e\u8457\u6539\u53d8\u5e74\u8f7b\u88ab\u544a\u7684\u672a\u6765,\u4f46\u7533\u8bf7\u65f6\u673a\u3001\u63d0\u4ea4\u7b56\u7565\u3001\u79fb\u6c11\u5ba1\u67e5\u987b\u540c\u6b65\u534f\u8c03\u3002\u5b8b\u5f8b\u5e08\u4e8b\u52a1\u6240\u63d0\u4f9b\u65b0\u6cfd\u897f\u5dde\u5211\u4e8b\u4e0e\u79fb\u6c11\u7efc\u5408\u54a8\u8be2,\u521d\u671f\u54a8\u8be2\u53ef\u9884\u7ea6\u3002<\/p>\n<div
