Income(SSI)\u3001Medicaid\u4ee5\u53ca\u5176\u4ed6\u57fa\u4e8e\u8d44\u4ea7\u5ba1\u67e5\u7684\u516c\u5171\u798f\u5229\u7684\u8d44\u683c\u3002\u89c4\u5219\u7cbe\u7ec6\u4e25\u683c:\u4e00\u6b21\u9519\u8bef\u7684\u5206\u914d\u5c31\u53ef\u80fd\u524a\u51cf\u6bcf\u6708\u7684SSI\u652f\u7968,\u6216\u89e6\u53d1Medicaid\u8d44\u4ea7\u8f6c\u79fb\u60e9\u7f5a\u671f\u3002\u6240\u5e78\u6574\u4f53\u6846\u67b6\u5df2\u753142 U.S.C. \u00a71396p(d)(4)\u660e\u786e\u89c4\u5b9a\u3002\u672c\u6587\u6309\u5b9e\u52a1\u89c6\u89d2\u68b3\u7406SNT\u7684\u6982\u5ff5\u3001NJ\u4e0eNY\u5e38\u7528\u7684\u4e09\u79cd\u7c7b\u578b\u3001ABLE\u8d26\u6237\u7684\u642d\u914d\u7b56\u7565\u3001\u53d7\u6258\u4eba\u7684\u9009\u62e9,\u4ee5\u53ca\u5bb6\u5ead\u6700\u5e38\u72af\u7684\u9519\u8bef\u3002<\/p>\n<h2>1. \u4ec0\u4e48\u662f\u7279\u6b8a\u9700\u8981\u4fe1\u6258?<\/h2>\n<p>\u8054\u90a6\u548c\u5dde\u7684\u793e\u4f1a\u4fdd\u969c\u8ba1\u5212\u5bf9\u8d44\u4ea7\u6709\u4e25\u683c\u9650\u5236\u3002\u5bf9\u4e8eSSI\u53d7\u76ca\u4eba,&#8221;\u53ef\u8ba1\u5165\u8d44\u4ea7(countable resources)&#8221;\u4e0a\u9650\u4e3a<strong>$2,000<\/strong>(SSA POMS SI 01110.003)\u3002NJ Medicaid ABD\u4e0eNY Medicaid\u7684\u989d\u5ea6\u7c7b\u4f3c\u3002\u5982\u679c\u6b8b\u969c\u4eba\u58eb\u83b7\u5f97\u9057\u4ea7\u3001\u4eba\u8eab\u4f24\u5bb3\u548c\u89e3\u91d1,\u6216\u5927\u989d\u8d60\u4e0e,\u8fd9\u4e9b\u8d44\u4ea7\u901a\u5e38\u4f1a\u8ba1\u5165\u4e0a\u9650,\u5bfc\u81f4\u798f\u5229\u4e2d\u6b62,\u5bb6\u5ead\u88ab\u8feb\u7d27\u6025&#8221;\u6d88\u8017\u8d44\u4ea7(spend-down)&#8221;\u3002<\/p>\n<p>\u7279\u6b8a\u9700\u8981\u4fe1\u6258\u901a\u8fc7\u5c06\u8d44\u4ea7\u7f6e\u4e8e\u4e00\u4e2a\u6cd5\u5f8b\u4e0a\u72ec\u7acb\u3001\u4ee5\u6b8b\u969c\u53d7\u76ca\u4eba&#8221;\u552f\u4e00\u5229\u76ca(sole benefit)&#8221;\u4e3a\u76ee\u7684\u7684\u5b9e\u4f53\u4e2d\u6765\u89e3\u51b3\u8fd9\u4e00\u95ee\u9898\u3002\u56e0\u4e3a\u53d7\u76ca\u4eba\u4e0d\u62e5\u6709\u4fe1\u6258\u672c\u91d1,\u4e5f\u65e0\u6cd5\u8981\u6c42\u73b0\u91d1\u5206\u914d,\u6240\u4ee5\u4fe1\u6258\u8d44\u4ea7\u4e0d\u8ba1\u5165\u8d44\u6e90\u4e0a\u9650\u3002\u53d7\u6258\u4eba\u7528\u4fe1\u6258\u8d44\u91d1\u652f\u4ed8\u653f\u5e9c\u9879\u76ee\u672a\u8986\u76d6\u7684&#8221;\u8865\u5145\u6027(supplemental)&#8221;\u9700\u6c42\u2014\u2014\u6cbb\u7597\u3001\u8f85\u5177\u3001\u4ea4\u901a\u3001\u6559\u80b2\u3001\u65c5\u884c\u3001\u79d1\u6280\u4ea7\u54c1\u3001\u4e2a\u4eba\u62a4\u7406\u7528\u54c1\u2014\u2014\u4ece\u800c\u63d0\u5347\u751f\u6d3b\u8d28\u91cf,\u540c\u65f6SSI\u4e0eMedicaid\u7167\u5e38\u6301\u7eed\u3002<\/p>\n<h2>2. \u4e09\u79cd\u7279\u6b8a\u9700\u8981\u4fe1\u6258<\/h2>\n<p>\u8054\u90a6Medicaid\u6cd5\u627f\u8ba4\u4e09\u79cd\u8f7d\u4f53,\u9009\u62e9\u54ea\u4e00\u79cd\u53d6\u51b3\u4e8e<em>\u7531\u8c01\u7684\u8d44\u4ea7<\/em>\u6765\u8bbe\u7acb\u4fe1\u6258\u3002<\/p>\n<div trust)\u3002\u56e0\u4e3a\u8d44\u91d1\u4ece\u672a\u5c5e\u4e8e\u53d7\u76ca\u4eba,\u6240\u4ee5\u53d7\u76ca\u4eba\u8eab\u6545\u540e<strong>\u65e0\u9700\u5411Medicaid\u507f\u4ed8<\/strong>\u2014\u2014\u4f59\u989d\u53ef\u4f9d\u5bb6\u5ead\u610f\u613f\u7559\u7ed9\u5144\u5f1f\u59d0\u59b9\u6216\u6350\u8d60\u6148\u5584\u673a\u6784\u3002<\/p>\n<h3>First-Party SNT (d4A)<\/h3>\n<p>\u5f53\u8d44\u91d1\u539f\u672c\u5c31\u5c5e\u4e8e\u53d7\u76ca\u4eba\u2014\u2014\u4f8b\u5982\u4eba\u8eab\u4f24\u5bb3\u548c\u89e3\u91d1,\u6216\u5bb6\u5ead\u5c1a\u672a\u6765\u5f97\u53ca\u89c4\u5212\u7684\u76f4\u63a5\u7ee7\u627f\u2014\u2014\u8054\u90a6\u6cd5\u5141\u8bb8\u8bbe\u7acb&#8221;d4A&#8221;\u81ea\u7b79(self-settled)SNT\u3002\u5fc5\u987b\u7531\u7236\u6bcd\u3001\u7956\u7236\u6bcd\u3001\u6cd5\u5b9a\u76d1\u62a4\u4eba\u3001\u6cd5\u9662,\u6216(\u81ea2016\u5e74Special Needs Trust Fairness Act\u4ee5\u6765)\u6709\u51b3\u5b9a\u80fd\u529b\u7684\u53d7\u76ca\u4eba\u672c\u4eba\u8bbe\u7acb\u3002\u8eab\u6545\u65f6\u4f59\u989d\u987b\u5148\u507f\u8fd8\u5ddeMedicaid,\u518d\u8f6c\u7ed9\u5269\u4f59\u53d7\u76ca\u4eba\u3002<\/p>\n<h3>Pooled Trust (d4C)<\/h3>\n<p>\u975e\u8425\u5229\u7ec4\u7ec7\u8fd0\u4f5c\u4e3b\u4fe1\u6258,\u5e76\u4e3a\u4e2a\u4eba\u8bbe\u7acb\u5b50\u8d26\u6237\u3002\u8d44\u4ea7\u89c4\u6a21\u4e0d\u5927\u7684\u5bb6\u5ead\u4e5f\u80fd\u5f97\u5230\u4e13\u4e1a\u4fe1\u6258\u7ba1\u7406,\u800c\u514d\u53bb\u72ec\u7acb\u53d7\u6258\u4eba\u7684\u6210\u672c\u8d1f\u62c5\u3002NJ\u4e0eNY\u5404\u81ea\u90fd\u6709\u6210\u719f\u7684Pooled Trust\u673a\u6784\u3002\u5f53\u548c\u89e3\u91d1\u8f83\u5c0f\u6216\u7f3a\u4e4f\u53ef\u9760\u7684\u4e2a\u4eba\u53d7\u6258\u4eba\u65f6,Pooled Trust\u5f80\u5f80\u662f\u53ef\u884c\u9009\u9879\u3002<\/p>\n<h2>3. SSI\u4e0eMedicaid\u8d44\u683c\u5982\u4f55\u5f97\u4ee5\u4fdd\u7559<\/h2>\n<p>\u673a\u5236\u6e05\u6670\u4f46\u4e25\u683c:\u56e0\u4e3a\u53d7\u76ca\u4eba\u4e0d\u638c\u63e1\u6240\u6709\u6743\u4e0e\u63a7\u5236\u6743,\u4fe1\u6258\u8d44\u4ea7\u4f9d\u636eSSA POMS SI 01120.200(\u4e00\u822c\u4fe1\u6258\u89c4\u5219)\u548cSI 01120.203(\u00a71396p\u4fe1\u6258\u4e13\u9879)\u4e0d\u6784\u6210&#8221;\u8d44\u6e90&#8221;\u3002\u53ea\u8981\u53d7\u6258\u4eba\u76f4\u63a5\u5411\u7b2c\u4e09\u65b9(\u5546\u54c1\/\u670d\u52a1\u63d0\u4f9b\u8005)\u4ed8\u6b3e,\u800c\u4e0d\u5c06\u73b0\u91d1\u4ea4\u7ed9\u53d7\u76ca\u4eba,\u5206\u914d\u4e5f\u4e0d\u7b97\u53d7\u76ca\u4eba\u7684&#8221;\u6536\u5165&#8221;\u3002<\/p>\n<div style=\"background:#f7f5f0;padding:20px;border-left:4px solid #98344A;margin:24px 0;\">\n<p style=\"margin:0;\"><strong>\u5b9e\u52a1\u63d0\u793a:<\/strong>\u53d7\u6258\u4eba\u5e94<strong>\u76f4\u63a5\u5411\u4f9b\u5e94\u5546\u4ed8\u6b3e<\/strong>\u2014\u2014\u7269\u7406\u6cbb\u7597\u8bca\u6240\u3001\u822a\u7a7a\u516c\u53f8\u3001\u7535\u5668\u96f6\u552e\u5546\u2014\u2014\u800c\u4e0d\u662f\u5148\u7531\u53d7\u76ca\u4eba\u57ab\u4ed8\u518d\u7531\u4fe1\u6258\u62a5\u9500\u3002\u62a5\u9500\u7ed9\u53d7\u76ca\u4eba\u7684\u6b3e\u9879\u53ef\u80fd\u88ab\u91cd\u65b0\u5b9a\u6027\u4e3a\u6536\u5165,\u8fdb\u800c\u524a\u51cfSSI\u3002<\/p>\n<\/div>\n<h3>ISM\u9677\u9631:\u98df\u7269\u4e0e\u4f4f\u623f<\/h3>\n<p>\u5373\u4fbf\u4fe1\u6258\u672c\u8eab\u8bbe\u7acb\u5408\u89c4,\u5982\u679c\u5b83\u4e3a\u53d7\u76ca\u4eba\u7684\u98df\u7269\u6216\u4f4f\u623f\u652f\u51fa(\u79df\u91d1\u3001\u6309\u63ed\u3001\u623f\u4ea7\u7a0e\u3001\u6c34\u7535\u8d39)\u4ed8\u6b3e,\u4ecd\u53ef\u80fd\u89e6\u53d1&#8221;\u5b9e\u7269\u8d61\u517b\u4e0e\u7ef4\u6301(In-Kind Support and Maintenance, ISM)&#8221;\u89c4\u5b9a,SSI\u5728&#8221;\u63a8\u5b9a\u6700\u9ad8\u503c(Presumed Maximum Value)&#8221;\u89c4\u5219\u4e0b\u6700\u9ad8\u88ab\u524a\u51cf\u7ea6\u4e09\u5206\u4e4b\u4e00(POMS SI 00835.300\u7cfb\u5217)\u3002\u5bb6\u5ead\u5728\u52a8\u7528\u4fe1\u6258\u652f\u4ed8\u5bb6\u5ead\u5f00\u9500\u524d\u5e94\u54a8\u8be2\u5f8b\u5e08:\u6709\u65f6\u63a5\u53d7ISM\u524a\u51cf\u66f4\u5212\u7b97,\u6709\u65f6\u6539\u7531ABLE\u8d26\u6237\u652f\u4ed8\u66f4\u5408\u9002\u3002<\/p>\n<h2>4. ABLE\u8d26\u6237\u4e0eSNT\u7684\u642d\u914d\u7b56\u7565<\/h2>\n<p>ABLE\u8d26\u6237(Achieving a Better Life Experience)\u75312014\u5e74\u7acb\u6cd5\u5236\u5b9a,\u89c4\u5b9a\u4e8e<strong>26 U.S.C. \u00a7529A<\/strong>,\u4e3a\u6b8b\u969c\u53d1\u751f\u4e8e46\u5c81\u524d(SECURE
