(\u533b\u7597\u8d39\u3001\u8bef\u5de5\u8d39\u3001\u75db\u82e6\u7cbe\u795e\u635f\u5931) \u4e4b\u5916,\u53e6\u884c\u4e3b\u5f20 Punitive Damages (\u4f18\u52bf\u8bc1\u636e) \u6807\u51c6\u3002<\/p>\n<h2 style=\"color:#1a1a1a;font-size:22px;margin:32px 0 12px;border-left:4px solid #98344A;padding-left:12px;\">\u65b0\u6cfd\u897f\u89c4\u5b9a<\/h2>\n<p style=\"line-height:1.85;color:#2a2a2a;margin:10px 0 14px;font-size:15.5px;\">NJ Punitive Damages Act, N.J.S.A. 2A:15-5.9 \u81f3 5.17\u3002\u4e3b\u8981\u6761\u6b3e:<\/p>\n<ul style=\"margin:8px 0 12px;padding-left:22px;color:#333;line-height:1.75;\">\n<li style=\"margin:5px 0;\">\u95e8\u69db (5.12): 0;\">\u83b7\u53d6\u5211\u4e8b\u6863\u6848: DWI \u8d77\u8bc9\u4e66\u3001BAC \u7ed3\u679c\u3001\u902e\u6355\u8b66\u5b98\u58f0\u660e\u3001DRE (\u6bd2\u54c1\u8bc6\u522b\u4e13\u5bb6) \u62a5\u544a<\/li>\n<li style=\"margin:5px 0;\">\u4e8b\u6545\u73b0\u573a CCTV\u3001\u884c\u8f66\u8bb0\u5f55\u4eea\u753b\u9762\u3001\u8f66\u8f86 EDR (\u4e8b\u4ef6\u6570\u636e\u8bb0\u5f55\u4eea) \u6570\u636e<\/li>\n<li style=\"margin:5px 0;\">\u88ab\u544a\u4ee5\u5f80 DWI \u524d\u79d1\u8bb0\u5f55 \u2014 \u5c61\u72af\u8005\u5927\u5e45\u5f3a\u5316 punitives<\/li>\n<li style=\"margin:5px 0;\">\u88ab\u544a\u8d22\u52a1\u53d1\u73b0 \u2014 \u56e0\u6cd5\u6848\u8003\u8651\u8d22\u52a1\u72b6\u51b5,\u5fc5\u987b\u901a\u8fc7 discovery \u8c03\u67e5\u8d44\u4ea7\u548c\u6536\u5165<\/li>\n<li style=\"margin:5px 0;\">\u8bc1\u4eba\u8bc1\u8bcd \u2014 \u86c7\u5f62\u9a7e\u9a76\u3001\u8d85\u901f\u3001\u95ef\u7ea2\u706f\u7b49\u8086\u610f\u884c\u4e3a<\/li>\n<li style=\"margin:5px 0;\">\u6bd2\u7406\u4e13\u5bb6\u89e3\u91ca BAC\u3001\u5927\u9ebb\u6216\u963f\u7247\u7c7b\u4ee3\u8c22\u7269\u7ed3\u679c<\/li>\n<li style=\"margin:5px 0;\">\u4ece\u6700\u521d\u8bc9\u72b6\u5373\u5c06 punitives \u5217\u4e3a\u72ec\u7acb\u8bf7\u6c42\u9879 \u2014 \u4e8b\u540e\u4fee\u6539\u6709 discovery \u95ee\u9898\u98ce\u9669<\/li>\n<\/ul>\n<h2 style=\"color:#1a1a1a;font-size:22px;margin:32px 0 12px;border-left:4px solid #98344A;padding-left:12px;\">\u5e38\u89c1\u8bef\u89e3<\/h2>\n<ul style=\"margin:8px 0 12px;padding-left:22px;color:#333;line-height:1.75;\">\n<li style=\"margin:5px 0;\">\u4fdd\u9669\u6db5\u76d6\u60e9\u7f5a\u6027\u8d54\u507f \u2014 \u9519\u3002\u5927\u591a\u6570\u65b0\u6cfd\u897f\u6c7d\u8f66\u4fdd\u5355\u4ee5\u8fdd\u53cd\u516c\u5171\u653f\u7b56\u4e3a\u7531\u660e\u786e\u6392\u9664 punitives\u3002<\/li>\n<li style=\"margin:5px 0;\">\u4ec5\u51ed DWI \u6709\u7f6a\u5224\u51b3\u5373\u81ea\u52a8\u83b7\u5f97 punitives \u2014 \u9519\u3002\u6c11\u4e8b\u6848\u4ef6\u5fc5\u987b\u4ee5 clear and convincing evidence \u5355\u72ec\u8bc1\u660e wanton disregard\u3002<\/li>\n<li style=\"margin:5px 0;\">Punitives \u603b\u662f\u8fbe\u5230 5 \u500d\u4e0a\u9650 \u2014 \u9519\u3002\u966a\u5ba1\u56e2\u6709\u88c1\u91cf\u6743,3 \u500d\u4ee5\u4e0b\u7684\u5224\u51b3\u5e38\u89c1\u3002<\/li>\n<li style=\"margin:5px \u662f\u72ec\u7acb\u7684\u3001\u4ee5\u60e9\u7f5a\u4e3a\u76ee\u7684\u7684\u8d54\u507f,\u4e0a\u9650\u4e3a 5 \u500d\u8865\u507f\u6027\u6216 $350K \u4e2d\u8f83\u5927\u8005<\/li>\n<li style=\"margin:5px 0;\">DWI \u5224\u51b3\u3001BAC \u8bc1\u636e\u548c\u524d\u79d1\u7684\u7ec4\u5408\u9a71\u52a8\u6210\u529f<\/li>\n<li style=\"margin:5px 0;\">Clear and convincing evidence \u662f\u4e3e\u8bc1\u6807\u51c6 0;\">\u5206\u5272\u5ba1\u7406\u907f\u514d\u966a\u5ba1\u56e2\u5728\u51b3\u5b9a\u8d23\u4efb\u65f6\u7684\u504f\u89c1<\/li>\n<li style=\"margin:5px 0;\">\u4fdd\u9669\u4e0d\u6db5\u76d6
