CONSULTATION

Song Law Firm provides free consultation for the cases below:

  • Personal Injuries
  • Labor and Employment Law
    • Key Aspects of the U.S. Labor Law Violation Lawsuit:
      • Wage and Overtime Pay Violations: Includes underpayment of minimum wage, failure to pay overtime, and violations of wage deduction rules.
      • Discrimination and Harassment: Cases of violations of anti-discrimination laws based on race, gender, religion, nationality, disability, and other protected categories.
      • Wrongful Termination: Termination without just cause or retaliatory discharge.
      • Safety and Health Violations: Non-compliance with workplace safety standards, exposure to hazardous materials, etc.
      • Vacation and Sick Leave Violations: Violations related to paid leave, sick leave, and relevant regulations.
      • Other Labor Law Violations: Breach of employment policies, non-payment of severance, and similar issues.
    • Litigation Process:
      1. Reporting:
File a complaint with the U.S. Department of Labor (DOL) and State Labor Agencies regarding the violation.
      2. Investigation:
The labor agencies will investigate the reported issues and may conduct on-site inspections if necessary.
      3. Judgment or Settlement:
Based on the investigation results, the agencies may issue corrective orders or facilitate a settlement between the employer and employee.
      4. Civil Litigation:
If dissatisfied with the agency’s decision or seeking greater compensation, a civil lawsuit can be filed.
    • Important Notes:
      • While the U.S. generally follows the “at-will employment” principle, wrongful termination based on discrimination, retaliation, or illegal reasons is prohibited.
      • Employers should be aware of and comply with labor laws to prevent violations.
      • Labor law disputes can be complex and require specialized legal knowledge; consulting with an attorney is highly recommended.
