Personal Injury Cases We Handle

From everyday rear-end collisions to complex rideshare and wrongful death matters, our team handles the full range of personal injury law throughout New Jersey and New York.

🚗

Car Accidents

Rear-end, T-bone, head-on, and multi-vehicle collisions. Insurance carriers' first offers typically cover only 30–50% of your actual losses. We build a complete strategy using PIP, UM/UIM, and third-party claims to maximize recovery.

📱

Uber, Lyft & Rideshare

Whether you were a passenger or struck by a rideshare driver, coverage depends on the driver's app status. Uber and Lyft maintain up to $1,000,000 in commercial coverage — we document the exact moment to unlock the highest tier.

🚶

Pedestrian & Bicycle

Crosswalks, parking lots, sidewalks. Beyond the driver's auto policy, your household auto insurance may provide secondary coverage. Strong record representing elderly clients and obtaining full policy-limit recoveries.

🏗️

Workplace Injuries

Construction sites, restaurants, warehouses, delivery work. Beyond Workers' Compensation, a third-party claim (against an equipment manufacturer or subcontractor) can substantially increase recovery. Available regardless of immigration status.

⚠️

Slip & Fall

Supermarkets, restaurants, apartment hallways, parking lots. Under premises liability law, early evidence preservation — CCTV requests, incident reports, witness statements — often determines the outcome.

🕊️

Wrongful Death

When a family member dies in an accident, surviving relatives may pursue a wrongful death claim. Family members residing outside the U.S. may also have standing. NJ and NY generally allow two years to file.

The First 72 Hours After an Accident

What you do in the first three days often determines the size of your recovery. Follow this order to protect your claim.

1

Get Medical Attention

Go to an ER or urgent care, even if you feel fine. Pain often appears 24–72 hours later. Without medical records, insurers will argue your injuries are unrelated.

2

Preserve Evidence

File a police report. Photograph vehicles, license plates, road conditions, injuries. Get witness names and phone numbers. Capture everything you can with your phone.

3

Don't Talk to Their Insurer

The opposing insurance company will call and request a "recorded statement." That call alone can cut your settlement in half. Say "my attorney will be in touch" and end the call.

4

Retain an Attorney

Hiring an attorney within 24–48 hours is the single biggest factor in maximizing recovery. Free consultation, no fee unless we win. You decide whether to proceed.

Frequently Asked Questions

Common questions from accident victims — answered by our personal injury team.

Can I speak with an attorney in Korean?
Yes. Founding member Joseph Song and Senior Associate Stacey Chung both speak fluent Korean and communicate with clients directly — no interpreter required. Korean-language consultations are available 24/7.
What does it cost to hire your firm?
Personal injury cases are handled on contingency. You pay no attorney fee unless we recover compensation for you. When we win, our fee is a percentage of the settlement or verdict, agreed in writing at the outset of representation.
How quickly should I hire an attorney after an accident?
As quickly as possible — ideally within 24 to 48 hours. Evidence (CCTV footage, vehicle damage, witness recollection) deteriorates rapidly, and the opposing insurer will try to obtain damaging statements from you directly. While New Jersey's statute of limitations for personal injury is generally two years, the first few days often determine the size of the recovery.
The insurance company offered me a settlement. Should I accept it?
The first offer from the opposing insurance carrier is almost always far below the actual value of your claim. Once you sign a release, you cannot pursue additional compensation — even if your injuries later worsen. Have any settlement offer reviewed by an attorney first. Song Law Firm reviews offers at no charge.
I was hit by an uninsured driver. Can I still recover?
Yes. If you carry UM/UIM (Uninsured/Underinsured Motorist) coverage on your own auto policy, your insurer will compensate you. New Jersey and New York require some baseline UM/UIM coverage, but the amount you have purchased determines how much you can ultimately recover.
I don't have car insurance and I was in an accident. What can I do?
Even uninsured drivers may have recovery options — through a household member's policy, the other driver's coverage, or other sources. New Jersey also offers limited-tier PIP options for uninsured drivers. Do not give up on a claim simply because you were uninsured at the time. Speak with an attorney first.
How are Uber and Lyft accidents different from regular car accidents?
Rideshare cases turn on the driver's app status at the moment of the crash. App off: only the driver's personal insurance applies. App on but no ride accepted: limited company coverage. Ride accepted through passenger drop-off: up to $1,000,000 in rideshare-company coverage. We document the exact moment to unlock the highest available tier.
I felt fine right after the accident, but pain started days later. Can I still file a claim?
Yes. Whiplash, disc injuries, concussions, and soft-tissue trauma routinely manifest 24–72 hours — sometimes weeks — after a collision. Document your symptoms with a medical provider as soon as they appear. The sooner you create a medical record, the stronger your claim.
I'm undocumented or have a complicated visa status. Can I still bring a personal injury claim?
Yes. Personal injury claims are independent of immigration status. Undocumented individuals, those with expired visas, and visitors all have the same right to recover. Song Law Firm does not share client information with immigration authorities. Your matter is confidential.
Can I file a Workers' Compensation claim and a personal injury lawsuit at the same time?
Sometimes, yes. Workplace injuries generally proceed under Workers' Compensation, but if a third party (equipment manufacturer, subcontractor, property owner) shares fault, a separate third-party personal injury action may be available. Pursuing both can substantially increase total recovery.
A family member died in an accident. Can relatives living overseas file a claim?
Yes. Wrongful death claims belong to the decedent's surviving spouse, children, and parents — and those family members may be located outside the United States. Song Law Firm has represented many overseas families and communicates directly with them in Korean when needed. New Jersey and New York wrongful death claims must generally be filed within two years.
How long does a personal injury case take?
It varies. Straightforward matters resolved within insurance limits typically conclude in 6 to 12 months. Cases involving severe injuries or contested liability can take 1 to 3 years. We handle all communication with insurance carriers and document production so clients can focus on their recovery, and we provide regular case updates in both English and Korean.
