新泽西丨上了愤怒管理课刑事案就免了吗?

在新泽西州,参加愤怒管理课程并不代表刑事案件会自动撤销,也不代表当事人一定不会受到刑事处罚。课程的法律效果主要取决于案件在哪一级法院审理、当事人面对的具体指控、是否有犯罪记录,以及检察官和法院是否已经作出正式的分流、认罪或判决安排。

如果案件在 Municipal Court(市法院) 审理,通常涉及相对较轻的案件,例如 disorderly persons offense、petty disorderly persons offense、市政条例违法或交通违法。新泽西市法院可以处理骚扰、简单攻击、扰乱秩序等常见指控,并且有权判处罚款、赔偿、缓刑、社区服务以及最长六个月的监禁。市法院没有陪审团审判。

在市法院案件中,当事人在案件结束前主动参加愤怒管理课程,通常可以作为有利的减轻因素。律师可以向市检察官说明,当事人已经认识到问题并主动接受教育或辅导,从而争取撤销指控、降低指控、减少罚款、避免监禁,或者达成较轻的认罪协议。但是,完成课程本身并不会迫使检察官撤案,法官也没有义务仅凭结业证书免除处罚。

部分符合条件的初犯可能有机会申请 Conditional Dismissal(附条件撤诉)。这是市法院的一种正式分流程序。当事人必须获得法院批准,并在规定期间内完成法院要求的全部条件;愤怒管理课程可能只是其中一项条件,还可能包括保持无新违法记录、支付费用、接受监督或完成其他辅导。只有在全部条件完成后,原指控才可能被正式撤销。Conditional Dismissal属于市法院的初犯分流机制,并不是当事人自行参加一门课程后自动获得的结果。

如果案件属于较严重的 indictable offense(可公诉罪行),例如一至四级犯罪,则通常由 Superior Court, Criminal Division(高等法院刑事庭) 审理。新泽西高等法院刑事庭负责处理成年被告的可公诉刑事案件;disorderly persons和petty disorderly persons案件通常由市法院处理。 即使较严重的刑事控告最初在市法院提出,案件之后也可能被移交县检察官审查,并进入高等法院程序;县检察官也可能把部分指控降级后退回市法院处理。

在高等法院案件中,愤怒管理课程一般更不可能单独换取撤案。检察官和法官会综合考虑指控等级、受害人的伤势、是否使用武器、是否存在威胁、当事人的犯罪记录、是否违反限制令,以及案件是否涉及家庭暴力等因素。提前完成课程可能有助于认罪协商或量刑,但通常只是众多考虑因素之一,当事人仍可能面对缓刑、监禁、罚款、赔偿、禁止接触令或其他刑事后果。

部分符合条件的高等法院被告可能申请 Pretrial Intervention(PTI,审前干预计划)。PTI是一种正式的刑事分流程序,通常由法院和Probation监督。法院可能要求当事人完成愤怒管理、心理评估、社区服务、赔偿、药物或酒精治疗,以及保持无新逮捕记录等条件。只有当事人被正式批准进入PTI并完成法院规定的全部条件后,相关刑事指控才会被撤销。仅仅自行完成愤怒管理课程,并不等于已经进入PTI。

如果案件涉及家庭暴力,还应注意刑事案件与 Superior Court, Family Division(高等法院家庭庭) 的限制令案件可能同时存在。例如,同一事件可能产生市法院或高等法院的刑事指控,同时产生家庭庭的临时或最终限制令案件。即使当事人完成愤怒管理课程,家庭庭法官仍会独立决定是否发生家庭暴力、是否需要签发最终限制令,以及是否需要禁止接触、没收武器、接受辅导或进行其他评估。

因此,无论案件是在Municipal Court还是Superior Court,最关键的都不是当事人是否拿到了一张愤怒管理课程结业证书,而是检察官的书面协议或法院命令是否明确规定:当事人完成课程及其他条件后,指控将被撤销、降级或作其他处理。在没有正式协议或法院命令的情况下,不能认为参加愤怒管理课程后就不会受到刑事处罚
