Legal Framework
New Jersey recognizes diminished value as a component of property damage. Three categories:
- Immediate Diminished Value: value loss before repairs

The New Jersey Supreme Court, in Universal Underwriters v. Wagner Buick (1993) and later cases, established residual value loss as a compensable damage category.
Five Practical Strategies

Second, cite the 17c Formula (3S Rule), widely used across the insurance industry: Base Loss = Market Value × 10% × Damage Factor (0.25–1.0) × Mileage Factor. Juries and adjusters understand and accept this formula.
Third, retain an independent appraiser. NJ permits auto dealers, repair experts, and certified appraisers to assess diminished value. Independent appraisals carry more weight than the insurer's internal estimate.
Fourth, do not miss the claim window. NJ's property damage statute of limitations is six years (N.J.S.A. 2A:14-1), but effective negotiation with the carrier should begin within 30–90 days of the accident to preserve leverage.
Fifth, distinguish your own (collision) coverage from the other party's (liability) coverage. Your own collision policy typically excludes diminished value, but the at-fault party's liability policy allows it. NJ no-fault applies only to bodily injury; property damage remains fault-based.
