Can I file for bankruptcy multiple times?

Computer generated bankrupt conceptual image

There is no limit to the number of times you can file for bankruptcy. However, if you file for bankruptcy multiple times, you can file for the next bankruptcy only after a certain period of time has elapsed from the time you filed the previous bankruptcy.

Take Chapter 7, the most common bankruptcy method. If you have previously received debt relief through Chapter 7 bankruptcy, and you want to apply for Chapter 7 again, you can do so after 8 years from the date of your previous bankruptcy filing. One thing to keep in mind here is that the base date is the date you previously filed for bankruptcy, not the date your previous bankruptcy was granted. For example, if you filed for Chapter 7 bankruptcy on February 1, 2012, and the bankruptcy was granted on October 1 of the same year, you can file for Chapter 7 bankruptcy again on February 1, 2020.

Also, as a reference, if you want to file for Chapter 13 in a situation where you have already received debt forgiveness through Chapter 7 bankruptcy, you can do so 4 years after the previous filing for bankruptcy.
