How much compensation can you get for a car accident like this?

Hello, I’m Joseph Song, a lawyer of Song Law Firm.

One of the most common questions I get asked in my practice is, “How much compensation can I get for an accident like this?”. From the perspective of the injured party, it is natural to want to know the actual amount of compensation or damages. However, “compensation for such an accident” is not a simple matter to calculate in the legal field, and the range of compensation must be considered from various angles.

For example, the same accident may affect a healthy person differently than a physically weak or defective person, and different jobs may pay different wages, and different people may have different standards of living. In some cases, people may seek psychiatric care due to the trauma of an accident. Do younger and older people suffer the same damage? Therefore, it is not possible to say exactly how much compensation or compensation is calculated by simply looking at the cost of hospital treatment for injuries, but rather by looking at various factors.

If there is no objective data on the extent of the injury, no matter how serious it is, it may be difficult to prove it, so you may not receive sufficient compensation or indemnity. You need to have sufficient medical records and test results, and you also need a medical expert’s opinion on the future treatment period and rehabilitation period, as well as an estimate of the cost. The same goes for lost wages. You can’t just say, “If I didn’t have an accident, I would have made a lot of money that day.” You need to have objective evidence, such as previous tax returns and contracts.

Finally, even with all of these resources, it’s difficult to get full restitution or compensation without a skilled attorney on your side. While you may not need to hire a lawyer for minor vehicle damage, in the case of bodily injury, you definitely need an experienced personal injury lawyer because you need to strategically analyze and determine the extent of your injuries, how much you can offer to settle for those injuries, whether the other party’s settlement offer is a good offer or not, whether further negotiation is necessary, whether it is advantageous to go to court, and if so, at what point, so that you can proceed with your case and get the full and maximum amount of compensation.

In addition, spouses who were not involved in a car accident may also be entitled to compensation. There was a case where a victimized spouse who had a husband who was eventually blinded after multiple surgeries as a result of a car accident injury sought compensation for damages incurred due to the dedication and care of the household, separate from the compensation of the victimized husband. The victimized spouse was eventually awarded damages for this part of the case through a lawsuit. In another case, the spouse of a victim who fractured his spine in an accident and became a paraplegic was also awarded damages by the court for nursing care and the inability to have sexual relations between the couple. This is known as loss of spousal support. This is where the skills of a lawyer are important, as there are some things that cannot be argued simply based on objective data.

In order to ensure that you receive the maximum amount of damages or compensation possible to mitigate your losses from your accident, it is imperative that you speak with an experienced and trustworthy personal injury lawyer, one who is recognized in the field, as soon as possible after your accident.
