Hello, this is the Immigration Team at Song Law Firm.
USCIS has announced a Special Student Relief policy that allows F-1 non-immigrant students experiencing severe economic hardship to work off-campus. The employment authorization will be valid until the student’s program end date, and cannot be extended beyond that date using this relief policy.
This Special Student Relief policy is valid for a period specified in the federal register, which currently allows for a validity period of 18 months. It applies to USCIS-issued employment authorizations during that period.
To qualify for this relief, the student must demonstrate that they are facing a severe economic hardship due to an emergency situation that affects a particular region and causes significant financial difficulties. This can include natural disasters, financial crises, and military conflicts, but is not limited to these situations.
This policy is effective immediately from the date of publication (February 22, 2023), and applies to all current and future applications for Special Student Relief employment authorization.
