Initial Validity of the O-1 Visa
- The O-1 visa is initially granted for up to three years, during which the visa holder must engage in specific work projects or artistic activities.
- If the artist has signed a contract with a production company, art institution, or performance group, the O-1 visa’s validity is generally aligned with the duration of the contract.
O-1 Visa Extensions
- The O-1 visa can be extended without a maximum time limit, provided that the visa holder continues to work in the same or related artistic field.
- An extension must demonstrate that the artist still requires additional time to complete their ongoing projects or has secured new artistic engagements.
- When applying for an extension, the artist must submit supporting documents showing that their current work is still ongoing or that new contracts or collaborations justify the need for an extension.
Multiple Extensions
- There is no limit to the number of O-1 visa extensions, as long as the artist remains engaged in qualifying artistic activities.
- After the O-1 visa expires, the individual may choose to switch to another visa category depending on their circumstances or apply for a green card (permanent residency) if they continue to achieve significant artistic accomplishments in the United States.
