Case Overview
Our client is a global consumer goods and retail strategy advisor with over 15 years of consulting experience. The client held panel/judge roles with three major industry associations across the U.S., Europe, and Asia; appeared in 20+ articles in major outlets (Forbes, Wall Street Journal, Bloomberg); and led multinational corporate strategy projects.
While in the U.S. on L-1A status, the client approached Song Law Firm to secure EB-1A permanent residency before reaching the L-1A seven-year cap.
Legal Issues
Unlike biotech or academic fields, advisory/consulting lacks quantitative markers like citations or papers. The core question was how to establish “international recognition.” While USCIS applies a “business field extraordinary ability” standard to executive/advisor EB-1A petitions, actual adjudication is more conservative than for academic fields.
L-1A overlap also creates adjudicator bias — “L-1A-level executive is insufficient for EB-1A.” We needed to shift the narrative from “executive” to “international expert.”
Song Law Firm Strategy
Our immigration team focused on five criteria:
1. Five-Criteria Focus — Judging, Published Material, Leading Role, High Salary, and Awards, with at least two pieces of independent evidence per criterion.
2. Formal Panel Appointment Letters — For Judging, we packaged official appointment letters, judging records, and association-president reference letters from the three associations.
3. Qualitative Media Analysis — Among 20 articles, we distinguished pieces where the client was the primary subject from passing mentions, submitting the 10 substantive articles in depth. We attached circulation and audience data for each outlet to satisfy “major trade publication.”
4. Salary Benchmarking — BLS and Mercer data demonstrated top 10% compensation within the client’s field.
5. Final Merits Narrative — We built a public-interest narrative: “global strategy advisor strengthening U.S. consumer goods industry competitiveness.”
Outcome
I-140 EB-1A approved. An initial RFE was issued, but Song Law Firm responded within 60 days with five additional reference letters, reinforced association appointment documentation, and media circulation data. L-1A to I-485 adjustment of status was completed before the L-1A expiration.
Lessons
Executive/advisor EB-1A can succeed “without numbers,” but narrative design is more demanding. Song Law Firm has accumulated experience in reconstructing the “expert rather than executive” narrative for L-1A/O-1 holders transitioning to EB-1A.
