F-1 OPT STEM Extension Approval — Overcoming I-983 RFE, Securing 24-Month Work Authorization

Case Overview

Our client is a STEM master’s degree holder in engineering who exhausted the initial 12-month OPT at a U.S. technology company and applied for the 24-month STEM OPT extension. USCIS issued an I-983 Training Plan RFE, prompting the client to engage Song Law Firm.

Legal Issues

The 24-month STEM OPT extension provides F-1 students with a combined 36 months (12 initial + 24 extension) of U.S. work experience. However, USCIS has tightened I-983 Training Plan scrutiny between 2024-2026, causing a sharp rise in RFEs citing weak degree-work connection, unclear supervision structure, or vague learning objectives.

The RFE in this case raised three issues: (1) the position description was overly broad as “software development,” making the connection to the master’s degree (mechanical engineering) unclear; (2) supervisor mentoring was only two 1-hour sessions per week; (3) learning objectives were abstract (“improve practical skills”).

Song Law Firm Strategy

Our immigration team undertook a full rewrite of the I-983 Training Plan.

1. Degree-Work Mapping — We created a 1:1 mapping table linking the client’s master’s coursework (Finite Element Analysis, Thermal Dynamics) to actual job duties (mechanical design CAD modeling, thermal simulation), with sample deliverables (design review PDFs) for each mapping.

2. Mentoring Structure — We restructured supervisor mentoring from 2×1 hour/week to 3×1.5 hours/week plus monthly 2-hour formal reviews, expanding total monthly mentoring to 10+ hours. We also submitted mentoring record templates.

3. Learning Objectives — We replaced abstract goals with measurable milestones: “achieve Advanced-level certification in specific CAD software within 6 months,” “lead 3 thermal analysis reports within 12 months,” “lead new product thermal design within 18 months.”

4. Supervisor Signatures and Company Letter — With the new I-983, we re-secured supervisor signatures, an official company letter, and the DSO signature from the degree institution.

Outcome

Approved within 30 days of RFE response filing. The 24-month STEM OPT extension was granted, securing 36 total months of U.S. work experience. The client plans to pursue H-1B sponsorship from the employer with Change of Status.

Lessons

STEM OPT extension RFEs are about document quality, not document volume. Song Law Firm rebuilds I-983 Training Plans along three axes — clear degree-work connection, structured supervision, measurable learning objectives — maintaining a 90%+ RFE response approval rate.
