Market Research Analyst’s H-1B transfer has been successfully approved. Recently, the Immigration Service’s request for additional H-1B documents and rejection rates for positions related to market research or marketing have increased exponentially. Presumably, Immigration and Immigration appears to be determining that the positions do not correspond to the professional occupations that require the minimum Bachelor’s degree required by the H-1B. The previous deference policy, which had been relatively easily approved when foreigners who already had H-1Bs moved to a new company or applied for an extension at the same sponsor company, was recently abolished by the Immigration Service, and now all cases are subject to the new case examination criteria. It is no longer useful to apply for an H-1B transfer or extension in the old way because of the strict screening process.
