Sued for breach of lease agreement, successfully dismissed.

Song Law Firm successfully defended a client who was sued by his landlord for breach of contract.

Our client, who rented a warehouse for his business, suffered damage due to flooding on four occasions. He complained to the landlord, the owner of the building, but did not receive any response. After realizing that the building was not suitable for use as a warehouse due to the low ground level caused by the flooding, and that the roof kept leaking water, he stopped using the warehouse and stopped paying rent. Several months later, he received a letter from the landlord stating that the unpaid rent and the contract were still valid.

While responding to the complaint, we carefully reviewed the lease agreement and filed a counterclaim, claiming breach of contract for damages sustained during the use of the warehouse, as well as breach of a clause in the lease requiring disclosure of flood zones. The landlord attempted to have the counterclaim dismissed, but our law firm strategically defended against it, and soon the landlord’s claims were dismissed and the case was successfully concluded.
