Entrepreneur’s NIW Petition Approval

The advantage of the NIW for overseas entrepreneurs/businessmen is that it does not require a labor certification process, which is an essential part of the general employment permanent residency process, so the permanent residency process is short, and sponsorship from a US employer is not required. After the newly adopted case of Matter of Dhanasar, this condition was relaxed and replaced with the need to demonstrate the value and national significance of the applicant’s field of expertise. In other words, it is enough to prove that the entrepreneur’s contribution will have a significant impact on profits (eg, labor creation and economic development) for a particular economic downturn region without the need to prove that it is of national significance. Also, where previously an entrepreneur’s contribution had to be proven to be a sure success, now it’s just a matter of demonstrating what your plans are and how well you are positioned to achieve those goals.
