IMMIGRATION LAW · SONG LAW FIRM SUCCESS STORY
Client Profile
- Nationality: Chinese. Female professional in her thirties working in fashion/creative industries (anonymized).
- Status: Current O-1B with recent extension approval. Existing Song Law Firm EB-1A client.
- Green card track: EB-1A I-140 approved; awaiting priority date to become current.
- Trigger: Decision to voluntarily end employment with the current O-1 petitioner and transition to a new agency representation.
Case Background
In late September 2026, the client decided to leave her current O-1 petitioner — a luxury brand in New York — and set a last working day. She needed a strategy that filed a new agency-based O-1 petition within the 60-day grace period so her status would not lapse. Her EB-1A I-140 was already approved, but the priority date was not current, so an I-485 was not yet an option. Song Law Firm designed a dual track: maintain nonimmigrant status via an O-1 agency transfer while continuing to wait on the EB-1A priority date.
Legal Issues
The O-1 60-day grace period rests on 8 CFR 214.1(l)(2). After employment ends, the beneficiary may remain in the U.S. for 60 days or until the I-94 expires, whichever is shorter. Filing a new I-129 inside that window places the matter in a pending status that, if approved, restores work authorization under the new petitioner.
O-1 is a petitioner-specific visa — the H-1B portability provision (INA 214(n)) does not apply. The new agency must file a full new I-129 package; there is no automatic "transfer" by virtue of a prior approval.
Agency-petition requirements are set by 8 CFR 214.2(o)(2)(iv)(E). The agency must either (1) organize services for multiple employers under an itinerary with specified end dates, or (2) act as the sole agent for a single employer. The itinerary must specify the dates, locations, and compensation for every performance, exhibition, or project.
Song Law Firm Strategy
Song Law Firm built the package as follows.
- Representation agreement with the new agency, signed within seven to ten days of the grace-period start to maximize runway.
- Itinerary — a three-year engagement forecast (exhibitions, residencies, commissions, teaching, mentoring). Each engagement specifies date, location, compensation, and sponsoring entity. Prospective engagements are tagged "anticipated" and supported by invitations, selection notices, or letters of intent.
- Extraordinary-ability re-evidence — reuses the prior O-1 evidence base and updates it with three years of new awards, exhibitions, press, peer recognition, and professional-organization memberships.
- Advisory opinion — a renewed peer-consultation letter from the required professional organization (or union) in the field.
- EB-1A priority-date tracking — monthly review of the Visa Bulletin after I-140 approval, with an action plan to pivot to I-485 or consular processing the moment the date becomes current.
- Form I-129 Premium Processing ($2,805) — used to secure a 15-day adjudication window well before the grace period expires.
Process
- Late September 2026: client gave notice; Song Law Firm completed the status-maintenance consultation.
- Early October 2026: representation agreement with the new agency executed; itinerary draft completed.
- Mid-October 2026: evidence package finalized (awards, press, exhibition portfolio, advisory opinion); I-129 filing ready.
- Late October 2026: I-129 filed with Premium Processing. Buffer of twenty-plus days between the filing receipt and the end of the 60-day grace period.
- Early November 2026: approval expected within the USCIS 15-day Premium Processing window.
Result
- O-1 extension under the former petitioner remained in place; new agency-based I-129 filed within the grace period.
- Filing inside the grace period preserved lawful status. Premium Processing eliminates any employment gap on approval.
- EB-1A priority-date wait continues without disruption; the structure allows immediate pivot to a concurrent I-485 the moment the date becomes current.
Lessons
- O-1 is petitioner-specific — H-1B portability does not apply, so any change of sponsor requires a full new I-129 package.
- The 60-day grace period authorizes presence, not employment — no work may resume until the new petition is approved.
- Agency-petition approval turns on itinerary quality. The more precisely dates, locations, compensation, and sponsors are documented, the better the odds.
- Premium Processing functions as insurance when the grace period is short. The $2,805 investment removes the status-gap risk.
- EB-1A beneficiaries whose priority date has not yet reached current frequently rely on recurring O-1 cycles to maintain nonimmigrant status. Song Law Firm has handled a number of these EB-1A/O-1 cross-category matters.
- If the priority date goes current during the grace period, the matter immediately converts to an I-485 strategy — monthly Visa Bulletin tracking is non-negotiable.
